1. What information do we collect?
Personal information you disclose to us
In short: we collect the personal information you choose to give us.
We collect personal information that you voluntarily provide when you contact us, join our email list, book a reading, or otherwise reach out. The personal information we collect depends on how you interact with us, and may include:
- Names
- Email addresses
- The subject you select on the contact form, which is either a question about readings, booking help, or something else
- The contents of your message, including anything you choose to tell us about your situation or the person you hope to connect with
- Your email list preference, meaning whether you asked to receive occasional updates
Sensitive information. We do not ask for and do not process sensitive information such as health, religious, or biometric data. Because of the nature of our work, you may choose to write something personal in a message to us. Anything you share is handled confidentially and is used only to respond to you.
Payment data. We do not collect or store payment card or bank account details on this website. Payment is arranged separately through PayPal, Venmo, Zelle, Cash App, or Apple Pay, and any information you give those services is handled under their own privacy policies.
Booking data. Bookings are made through Calendly, which is a separate service. Whatever you enter on a Calendly page is collected by Calendly under its own privacy policy, and shared back with us so we can hold your appointment.
All personal information you provide must be true, complete, and accurate, and you must tell us if any of it changes.
Information automatically collected
In short: basic technical information is logged automatically when you visit, and it does not reveal who you are.
Like most websites, this site is served by a hosting provider that automatically records limited technical information when a page is requested. That information may include your IP address, browser and device type, the page you requested, the page that referred you, and the date and time of the request. We use it to keep the site running, to diagnose problems, and to protect against abuse. We do not use it to identify you.
2. How do we process your information?
In short: to reply to you, to deliver our services, to send updates you asked for, and to keep the site secure.
We process your personal information for the following reasons:
- To respond to your questions and to provide the readings and services you request.
- To schedule, prepare for, and deliver sessions, including rescheduling and follow-up.
- To send you occasional updates about openings, events, and new offerings, but only if you asked to be added to the email list.
- To keep our Services safe and working, including preventing spam and abuse of our forms.
- To comply with our legal obligations, and to establish, exercise, or defend legal claims where necessary.
We do not sell your personal information, we do not share it for cross-context behavioral advertising, and we do not use it for automated decision-making or profiling.
3. What legal bases do we rely on?
In short: we only process your information when we have a valid legal reason to do so.
If you are located in the EU or the UK, the General Data Protection Regulation and the UK GDPR require us to explain the legal bases we rely on. Those bases are:
- Consent. You have given us permission to process your information for a specific purpose, such as sending you email updates. You may withdraw your consent at any time.
- Performance of a contract. We need to process your information to provide a reading you have booked, or to take steps at your request before booking.
- Legitimate interests. We may process your information to reply to your enquiries, to keep our website secure, and to run our practice, where doing so does not override your rights and freedoms.
- Legal obligations. We may process your information where the law requires it, or to defend our legal rights.
If you are located in Canada, we process your information with your express or implied consent, which you may withdraw at any time.
4. When and with whom do we share your information?
In short: only with the providers that help us operate this site and our practice.
We share personal information with the following categories of third parties, who act on our behalf or provide a service you have chosen to use:
- Form delivery. Messages sent through our contact form and email list sign-up are processed by FormSubmit, which passes them to our email inbox.
- Website hosting. Our site is hosted by Vercel, which serves our pages and keeps standard server logs.
- Fonts. Our pages load typefaces from Google Fonts. Because the fonts are requested from Google's servers, Google receives your IP address as part of that request. No account information is shared, and no advertising cookie is set by us.
- Scheduling. Bookings are handled by Calendly under its own privacy policy.
- Payments. Payments are handled by PayPal, Venmo, Zelle, Cash App, or Apple Pay, each under its own privacy policy.
- Email. Our email is provided by Google, which stores the messages you send us.
We may also disclose your information if the law requires it, or in connection with a business transfer such as a merger or sale of assets. We do not sell, rent, or trade your personal information to anyone for their own marketing.
5. Do we use cookies and other tracking technologies?
In short: we set no tracking or advertising cookies, and we run no analytics.
This website does not set advertising or analytics cookies of its own. We do not run Google Analytics, advertising pixels, or third-party trackers. There is no cookie banner because there is nothing to consent to.
One point for completeness: the outside services listed above, such as Calendly and the payment providers, may set their own cookies once you are on their pages, under their own policies.
If we ever add analytics, this notice will be updated first.
6. How long do we keep your information?
In short: only as long as we need it for the purpose we collected it.
- Messages you send us are kept in our email inbox for as long as needed to respond, to keep a record of our correspondence, and to meet any legal or tax obligation.
- Email list addresses are kept until you unsubscribe or ask to be removed.
- Booking records are kept under Calendly's retention settings and our own records for the period required for scheduling and accounting.
- Server logs are kept for a short period by our hosting provider and then deleted or aggregated.
When we no longer have a legitimate need to process your information, we delete it or anonymize it. Where deletion is not immediately possible, for example because information sits in a backup, we securely store it and isolate it from further processing until deletion is possible.
7. How do we keep your information safe?
In short: we use reasonable safeguards, but no method is completely secure.
We use appropriate organizational and technical measures to protect the personal information we process, including transport encryption on our website and access controls on our email. Despite our safeguards, no electronic transmission or storage can be guaranteed to be completely secure, so we cannot promise that hackers or other unauthorized third parties will never defeat our security. You transmit personal information to us at your own risk.
8. Do we collect information from minors?
In short: no. Our Services are for adults 18 and over.
We do not knowingly collect, solicit, or market to anyone under 18 years of age. By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to that minor's use of the Services. If we learn that we have collected personal information from a user under 18, we will deactivate the record and take reasonable steps to delete that information promptly. 9. What are your privacy rights?
In short: you can ask to see your information, correct it, delete it, or withdraw your consent.
Depending on where you live, you may have the right to request access to the personal information we hold about you, to ask us to correct or delete it, to restrict or object to our processing of it, and where applicable to receive a copy in a portable format. Withdrawing your consent. Where we rely on your consent, you may withdraw it at any time. This will not affect the lawfulness of processing before the withdrawal, and it will not affect processing carried out on other lawful grounds.
Opting out of email. You can unsubscribe at any time by replying to any email from us and asking to be removed, or by emailing the address above. You will still receive messages that are necessary to administer a booking you have made.
If you are in the EU or the UK and believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. In the UK, that is the Information Commissioner's Office. In Switzerland, that is the Federal Data Protection and Information Commissioner.
10. Controls for do-not-track features
Most browsers include a Do-Not-Track ("DNT") setting. No uniform standard for recognizing DNT signals has been finalized, so we do not currently respond to them. This is a moot point in practice, since we do not track you across websites at all. If a standard is adopted, we will update this notice.
11. Do United States residents have specific privacy rights?
In short: yes, and we extend the same choices to everyone.
If you are a resident of a state with a comprehensive privacy law, including California, Colorado, Connecticut, Virginia, and others, you may have the right to request access to your personal information, to request correction or deletion, to obtain a copy, and to be free from discrimination for exercising those rights.
We do not sell personal information, we do not share it for cross-context behavioral advertising, and we do not process it for targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects. We have not sold or shared personal information in the preceding twelve months.
To exercise a right, email askspiritwithmichael@gmail.com with enough detail for us to verify who you are. We will respond within the period required by your state's law. If we decline a request, you may appeal by replying to our response, and we will explain the outcome in writing.
12. Do other regions have specific privacy rights?
In short: visitors in the UK, the EU, Canada, and Australia may have additional rights.
We occasionally read for clients outside the United States. If you are located in the United Kingdom or the European Economic Area, the rights described in section 9 apply to you, and our legal bases are set out in section 3. Because our practice and our service providers are based in the United States, your personal information may be transferred to and processed in the United States. Where required, we rely on appropriate safeguards for those transfers, including standard contractual clauses used by our service providers.
If you are located in Canada or Australia, you may request access to the personal information we hold about you and ask us to correct it. In limited circumstances permitted by law, we may be unable to provide access, and we will explain why if that happens.
13. Do we make updates to this notice?
In short: yes, we update this notice as needed to stay compliant.
We may update this Privacy Notice from time to time. The updated version will be marked with a revised date at the top of this page and takes effect as soon as it is posted. If we make material changes, we will notify you either by posting a prominent notice or by contacting you directly. We encourage you to review this notice periodically.
